Terms of Service

1. Agreement to Terms

By downloading, accessing, or using the Explorable mobile application or website (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

The Service is operated by XP LLC (“Explorable,” “we,” “us,” or “our”).

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, your parent or legal guardian must have reviewed and agreed to these Terms on your behalf. We do not knowingly collect information from children under 13.

3. Your Account

• You must provide accurate, current information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must not share your account or let anyone else access it.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms.

4. The Service

Explorable is a curated city exploration platform. We hand-select places worth visiting and provide editorial recommendations. The Service includes browsing curated places, checking in with photos, saving places to lists, viewing leaderboards, earning points, and participating in experiences.

Explorable is an editorial platform — we curate what appears in the app. The inclusion of a place does not constitute an endorsement or warranty about that business.

5. User Content

“User Content” means any content you submit through the Service, including check-in photos, notes, lists, and profile information.

Your rights: You retain ownership of your User Content.

License you grant us: By submitting User Content, you grant Explorable a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable license to use, reproduce, modify, distribute, display, and create derivative works from your User Content in connection with operating, promoting, and improving the Service. This license survives termination of your account.

Your responsibilities:You represent that you own or have the rights to submit your User Content, it does not violate any third party's rights, and it is accurate and not misleading.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Submit false or misleading check-ins or content
• Harass, threaten, or intimidate other users
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Scrape, crawl, or use automated means to access the Service without our written permission
• Interfere with or disrupt the Service or its infrastructure
• Upload viruses, malware, or other harmful code
• Reverse engineer or decompile any part of the Service
• Use the Service to compete with Explorable or build a competing product

7. Intellectual Property

The Service and its original content — including curated place selections, editorial notes, design, graphics, branding, and software — are the property of XP LLC and protected by copyright, trademark, and other intellectual property laws. The Explorable name, logo, and related marks are trademarks of XP LLC.

8. Points and Leaderboards

Points and leaderboard rankings have no monetary value, cannot be exchanged for cash or goods, may be adjusted or reset at our discretion, and do not create any contractual obligation. Fraudulent activity may result in point removal and account suspension.

9. Push Notifications

With your permission, we may send push notifications including personalized recommendations, weekly challenges, streak reminders, and experience alerts. You can disable push notifications at any time through your device settings.

10. Referral Program

Referral rewards are subject to verification, may be modified or discontinued at any time, and are void if obtained through fraud, fake accounts, or self-referrals.

11. Experiences

Experiences are events hosted by third-party businesses. Explorable does not organize, host, or control these events and is not responsible for their quality, safety, or accuracy. The “I'm Interested” feature signals intent only — it does not constitute a reservation, ticket, or booking.

12. Third-Party Services

The Service may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or availability of any third-party services.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PLACE FEATURED WILL BE OPEN OR SUITABLE FOR YOUR PURPOSES. YOU USE THE SERVICE AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO EXPLORABLE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

15. Indemnification

You agree to indemnify and hold harmless XP LLC from any claims, liabilities, damages, or expenses arising out of your use of the Service, your User Content, or your violation of these Terms or any third party's rights.

16. Dispute Resolution and Arbitration

Informal Resolution First: Before filing any claim, contact us at legal@getexplorable.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: Unresolved disputes shall be resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules, conducted in South Dakota or remotely.

Class Action Waiver: Each party may only bring claims in their individual capacity, not as part of a class action.

Opt-Out: You may opt out of arbitration by sending written notice to legal@getexplorable.com within 30 days of first accepting these Terms.

17. Governing Law

These Terms shall be governed by the laws of the State of South Dakota, without regard to its conflict of law provisions.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the “Last Updated” date and, where appropriate, by push notification or in-app message. Continued use after changes take effect constitutes acceptance.

19. Termination

You may delete your account at any time through the app or by contacting us. Upon termination, your right to access the Service ceases immediately. Sections 5, 7, and 13–17 survive termination.

20. General

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Explorable.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign ours without restriction.
